Welcome to Sastro! The terms "we", "us", and "our" refer to Sastro . Sastro operates this online store and website, including all related information, content, features, tools, products, and services in order to provide you, the customer, with a curated shopping experience (the "Services"). Sastro is hosted and powered by Shopify, which enables us to provide the online platform to you.

The terms and conditions below, together with our integrated Refund and Returns Policy (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you access or use the Services.

Please read these Terms of Service carefully before accessing or using our website. Pay special attention to provisions in bold text, as these clauses limit our liability, impose indemnities, or allocate risk to you in accordance with the South African Consumer Protection Act 68 of 2008 ("CPA") and the Electronic Communications and Transactions Act 25 of 2002 ("ECTA").

By visiting, interacting with, or purchasing from our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or our Privacy Policy, you must not access or use our Services.

SECTION 1 - ACCESS, AGE OF MAJORITY AND ACCOUNT SECURITY

By agreeing to these Terms of Service, you represent that you are at least 18 years of age (the age of majority in South Africa) or that you are of full legal capacity to enter into binding contracts. If you are under 18, you may only use the Services under the supervision and with the explicit consent of a parent or legal guardian.

To use the Services, including browsing our online store or purchasing products, you may be required to provide personal information such as your name, email address, physical delivery address, and payment credentials. You represent and warrant that all information provided is accurate, current, and complete.

You are solely responsible for maintaining the confidentiality and security of your account credentials and for all activities that occur under your account. You may not transfer, assign, or license your account to any third party.

SECTION 2 - PRODUCTS AND ACCURACY OF DISPLAY

We make every reasonable effort to display as accurately as possible the colors, imagery, and specifications of our products. However, we cannot guarantee that your device's display, screen resolution, or settings will accurately reflect actual product colors or details.

In accordance with Section 56 of the CPA, products delivered to you are guaranteed to be of acceptable quality and suitable for their intended purpose. However, minor aesthetic variations standard to manufacturing or variations due to display devices do not constitute a defect.

Descriptions, specifications, and pricing of products are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time or limit sales quantities to any person, geographic region, or jurisdiction where permitted by law.

SECTION 3 - ORDERS, CONTRACT FORMATION AND CANCELLATION

3.1 Offer and Acceptance: When you place an order on our online store, your order constitutes an offer to purchase products under these Terms. A binding contract of sale is only formed when Sastro dispatches an explicit order confirmation email and receives successful payment clearance.

3.2 Order Modifications & Cancellations: We reserve the right to decline, cancel, or limit any order for valid operational or legal reasons (including suspected fraudulent transactions, system errors, or inventory stockouts). If we modify or cancel an order after payment has been processed, we will promptly notify you via the contact details provided and refund the appropriate amount without unnecessary delay.

3.3 Personal Use: You warrant that all purchases made via the Services are intended strictly for your personal, domestic, or household use, and not for unauthorized commercial resale or export.

SECTION 4 - PRICES, VAT AND PAYMENT

4.1 Pricing & VAT: All prices displayed on our website are listed in South African Rand (ZAR). Unless explicitly stated otherwise, all posted prices are inclusive of South African Value-Added Tax (VAT at the applicable statutory rate of 15%). Prices do not include delivery, courier, customs, or handling fees, which will be calculated and itemized separately at checkout prior to final payment authorization.

4.2 Errors: In the event of a manifest error in pricing or product information resulting from typing, technical, or system glitches, Sastro is not bound to honor the incorrect price, provided we inform you of the error before dispatching the items and offer you a full refund.

4.3 Payment Representations: You warrant that:

  • The payment card or banking information provided is true, correct, and complete;

  • You are duly authorized to use such card or account for the purchase; and

  • The charges incurred will be honored by your financial institution or credit card issuer.

SECTION 5 - SHIPPING, RISK AND DELIVERY

5.1 Delivery Area: We deliver products within the borders of South Africa using reputable third-party courier services.

5.2 Delivery Times: Delivery times provided during checkout or in order confirmations are estimated targets only and are not guaranteed delivery dates. To the maximum extent permitted by Section 19 of the CPA, Sastro shall not be liable for delivery delays caused by logistics providers, adverse weather, civil unrest, load shedding disruptions, customs holds, or force majeure events outside our reasonable control.

5.3 Passage of Risk: Subject to the CPA, risk of loss or damage to goods passes to you upon delivery of the items to the physical address designated in your order confirmation.

SECTION 6 - REFUND AND RETURNS POLICY

6.1 General Return Conditions

For any returned product to qualify for a refund or replacement, the item must strictly meet the following conditions upon delivery back to our facility:

  • Original & Perfect Condition: The product must be unused, unworn, undamaged, and in the exact perfect condition in which it was received.

  • Complete Components: The product must be returned with all original parts, accessories, spares, manuals, labels, and documentation included.

  • Original Packaging: The item must be returned in its original, undamaged product packaging.

Please note: Items returned to us incomplete, missing parts or spares, damaged, or without their original packaging will not qualify for a refund or replacement and will be returned to you at your expense.

6.2 Replacements (One-Time Replacement Rule)

  • One-Time Replacement: If you receive an item that you wish to replace, we will arrange one (1) single replacement for that order.

  • Subsequent Dissatisfaction: Should the replacement item still not be satisfactory to you, no further replacements will be issued.

  • Final Refund Option: In the event that the replacement item is still not satisfactory, only a refund will be offered as the final resolution. This refund will only be processed once the replacement item is delivered back to us in perfect condition, complete with all parts, spares, and original packaging.

6.3 ECTA Statutory 7-Day Cooling-Off Period (Section 44)

In terms of Section 44 of the Electronic Communications and Transactions Act 25 of 2002 (ECTA):

  • You have the legal right to cancel any transaction for goods purchased through our website without reason and without penalty within 7 (seven) days after the date you receive the goods.

  • To exercise your cooling-off right, you must notify us in writing at info@sastro.co.za within the 7-day period.

  • You will be responsible for the direct cost of returning the goods to our address .

  • Returned goods must meet the condition criteria set out in Section 6.1 above.

  • In accordance with ECTA, qualifying refunds under this section will be credited back to your original payment method within 30 (thirty) days of cancellation.

6.4 CPA Defective Goods & Statutory Warranty (Section 56)

In terms of Section 56 of the Consumer Protection Act 68 of 2008 (CPA):

  • All goods supplied are subject to a statutory 6 (six) month warranty against material defects or failure.

  • If a product is delivered to you with a manufacturing defect or is unsafe, you are entitled to notify us within 6 (six) months of delivery to arrange a return.

  • Upon receiving and inspecting the item, if a genuine manufacturing defect is confirmed, we will provide you with your choice of a repair, replacement, or full refund.

  • This statutory warranty does not cover ordinary wear and tear, intentional or negligent damage, misuse, neglect, or failure to follow product care instructions.

6.5 Return Instructions

To initiate a return or replacement:

  1. Contact us at info@sastro.co.za with your order number, contact details, and reason for return.

  2. Once authorized, safely pack the product with all original components, parts, spares, and original packaging.

  3. Upon delivery, our team will inspect the item. Once approved, your refund or one-time replacement will be processed.

SECTION 7 - INTELLECTUAL PROPERTY

7.1 Ownership: All intellectual property on our website and Services—including trademarks, trade names, text, graphics, logos, images, design layouts, product listings, software, and audio/video files—is the property of Sastro, its licensors, or Shopify, and is protected under South African law (including the Copyright Act 98 of 1978 and Trade Marks Act 194 of 1993) and international conventions.

7.2 Limited License: You are granted a limited, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial shopping purposes only. You may not copy, reproduce, distribute, modify, create derivative works from, scrape, or exploit any content from the site without our express prior written permission.

SECTION 8 - OPTIONAL THIRD-PARTY TOOLS AND LINKS

8.1 Third-Party Tools: We may provide access to optional third-party software, integrations, or tools (e.g., payment gateways, chat plugins, courier trackers) which we neither monitor nor control. You acknowledge and agree that access to such tools is provided on an "as is" and "as available" basis without any warranties or endorsements. We assume no liability arising from your use of third-party tools.

8.2 External Links: Third-party hyperlinks on this site may direct you to external websites not affiliated with Sastro. We are not responsible for examining or evaluating the content, accuracy, or privacy practices of these third-party websites and disclaim all liability for any loss or damage incurred through your interactions with them.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

Sastro is powered by Shopify Inc., which provides the technical e-commerce hosting platform for our store. You acknowledge and agree that all transactions and sales contracts are entered into directly between you and Sastro. Shopify is not a party to your transactions and bears no legal responsibility or liability for any products, services, or fulfillment provided by Sastro. You hereby release Shopify from any claims, damages, or liabilities arising from or related to your interactions with Sastro.

SECTION 10 - PRIVACY AND DATA PROTECTION (POPIA)

10.1 POPIA Compliance: Personal information collected during your use of our website and purchase of products is processed strictly in accordance with the Protection of Personal Information Act 4 of 2013 ("POPIA") and our Privacy Policy.

10.2 Cross-Border Transfers: Because our store is hosted by Shopify, your personal information may be transmitted, processed, or stored on secure servers located outside South Africa (including in Canada, the United States, and the European Union). By using our Services, you consent to the cross-border processing of your personal data as strictly necessary for contract fulfillment and platform operation, in accordance with Section 72 of POPIA.

SECTION 11 - CUSTOMER REVIEWS AND USER FEEDBACK

If you submit product reviews, feedback, ideas, suggestions, or comments ("Feedback"), you grant Sastro a perpetual, worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, modify, translate, publish, and distribute your Feedback across any marketing channels or media.

You warrant that your Feedback does not violate third-party rights (including intellectual property or privacy rights) and does not contain unlawful, defamatory, or obscene material. We reserve the right to remove any Feedback deemed offensive, misleading, or inappropriate at our sole discretion.

SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS

Occasionally, information on our website may contain technical or typographical errors, inaccuracies, or omissions regarding product descriptions, pricing, promotions, shipping fees, transit times, and stock availability. We reserve the right to correct any errors and to update information or cancel orders if any information is inaccurate, subject to notifying affected consumers prior to order fulfillment.

SECTION 13 - PROHIBITED USES

In addition to other restrictions set forth in these Terms, you are prohibited from using the site or its content:

14.1 Scope: "Agent" means any automated software, bot, crawler, scraper, or semi-autonomous service that accesses or interacts with the Services on behalf of a person or entity.

14.2 Technical Standards: No Agent may access or interact with the Services unless it:

  • Clearly identifies itself in HTTP/HTTPS headers by declaring "Agent/[agent name]";

  • Does not mimic human interaction patterns to circumvent CAPTCHAs or rate controls;

  • Responds truthfully to automated query prompts; and

  • Refrains from accessing the site if explicitly restricted or blocked by security rules.

16.1 General Disclaimer: To the fullest extent permitted under South African law (including the CPA), the Services and all products delivered to you are provided "as is" and "as available" for your use, without any representations, warranties, or guarantees of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title, or non-infringement.

16.2 Service Availability: We do not guarantee or warrant that your use of the website or Services will be uninterrupted, timely, error-free, or entirely secure from external cyber threats.

SECTION 17 - LIMITATION OF LIABILITY

17.1 Exclusion of Indirect Damages: To the maximum extent permitted by South African law (and subject to Section 61 of the CPA regarding product liability), neither Sastro, its directors, employees, affiliates, agents, contractors, suppliers, nor Shopify shall be liable for any indirect, incidental, punitive, special, or consequential damages, including loss of profits, lost revenue, lost data, or business interruption, arising out of your use of or inability to use the Services or products.

17.2 Statutory Rights: Nothing in these Terms excludes, restricts, or modifies any statutory customer rights guaranteed under the Consumer Protection Act 68 of 2008 or the Electronic Communications and Transactions Act 25 of 2002 that cannot be lawfully limited or excluded.

SECTION 18 - INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Sastro (SASTRO MART TRADING ENTERPRISES (PTY) LTD), Shopify, and our affiliates, directors, officers, employees, agents, and service providers from and against any third-party claims, losses, liabilities, costs, or expenses (including reasonable legal costs on an attorney-and-own-client scale) arising out of or related to: (i) your breach of these Terms of Service; (ii) your violation of any South African law or the rights of a third party; or (iii) your fraudulent use of or willful misconduct regarding the Services.

SECTION 19 - SEVERABILITY

If any provision of these Terms of Service is determined by a South African court of competent jurisdiction to be unlawful, void, or unenforceable, such provision shall nevertheless be enforced to the maximum extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms. Such determination shall not affect the validity and enforceability of any remaining provisions.

SECTION 20 - ENTIRE AGREEMENT AND WAIVER

The failure of Sastro to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. These Terms of Service and any operating policies posted on this site constitute the entire agreement and understanding between you and Sastro governing your use of the Services, superseding all prior oral or written agreements or communications.

SECTION 21 - GOVERNING LAW AND JURISDICTION

These Terms of Service, their interpretation, and any dispute arising out of or in connection with your use of the Services or purchase of products shall be governed exclusively by and construed in accordance with the laws of the Republic of South Africa. You and Sastro submit to the non-exclusive jurisdiction of the High Court of South Africa (Gauteng Local Division, Johannesburg) for the resolution of any legal proceedings.

SECTION 22 - AMENDMENTS TO TERMS OF SERVICE

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates to our website. It is your responsibility to review our website periodically for changes. Your continued use of or access to our website following the posting of modifications constitutes acceptance of those changes.
